1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of:

• The TalkPebble website at https://talkpebble.com
• The TalkPebble mobile application
• Related materials and services we make available in connection with them

By using TalkPebble, you agree to these Terms. If you do not agree, please do not use the website or app.

2. About TalkPebble

TalkPebble: Speech & Language (TalkPebble) offers educational information for parents and caregivers about early speech, language, and communication, along with parent-guided activity ideas and in-app tools. The website and mobile app are complementary; features available in the app (such as accounts or Communication Check) may not all be available on the public website. The website may also offer an Early Access signup for parents who want to be notified when the app is ready.

3. Eligibility and Accounts

TalkPebble is intended for parents and caregivers. You must be old enough to form a binding contract in your jurisdiction (and at least 18 where required) to create an account. Accounts are for adult caregivers; children should not create or control TalkPebble accounts.

If you create an account in the mobile app, you agree to provide accurate information, keep your login credentials confidential, and notify us if you suspect unauthorized access. You are responsible for activity under your account.

You may sign in with email and password or with Google (where available). If you use Google Sign-In, you are also subject to Google's terms for your Google account. Optional push notifications (such as daily practice reminders) are available in Profile; they are not required to use TalkPebble.

4. Educational Purpose

Content and features in TalkPebble are general and educational. They are intended to help parents understand common topics and try simple everyday interaction ideas. They are not individualized clinical advice.

5. Not Medical Advice

Nothing on TalkPebble is medical advice, clinical guidance, or a substitute for consultation with a qualified healthcare or allied-health professional who knows your child.

6. No Diagnosis or Treatment

TalkPebble does not:

• Diagnose speech or language disorders or any other condition
• Provide medical diagnosis
• Provide therapy, treatment plans, or clinical screening results
• Guarantee any developmental outcome
• Provide emergency services

Features such as a Communication Check, progress notes, or coaching-style tips are educational and reflective tools for parents. They are not assessments, diagnoses, or clinical records.

7. Professional Support

If you have concerns about your child’s speech, language, hearing, or development, please speak with a qualified professional such as your child’s doctor or a speech-language pathologist. You do not need to use TalkPebble before seeking professional support. TalkPebble does not replace a speech-language pathologist or physician.

8. User Responsibilities

You agree to use TalkPebble lawfully and responsibly, including by:

• Using the services for personal, non-commercial informational purposes unless we agree otherwise
• Entering information about a child only if you are authorized to do so as a parent or caregiver
• Not attempting to disrupt, scrape abusively, or gain unauthorized access to the site, app, or related systems
• Not misrepresenting TalkPebble content as professional clinical advice

9. Acceptable Use

You may not use TalkPebble to:

• Violate any applicable law or regulation
• Infringe intellectual property or privacy rights
• Transmit malware or harmful code
• Harass, abuse, or harm others
• Interfere with the security or operation of the services

10. Intellectual Property

The TalkPebble name, branding, website and app design, text, graphics, and other content are owned by TalkPebble or its licensors and are protected by applicable intellectual-property laws. You may view and share links for personal use. You may not copy, modify, distribute, or create derivative works from our content for commercial purposes without prior written permission.

11. Third-Party Services and Links

TalkPebble may use third-party service providers (for example hosting, analytics, Google Sign-In, and push notification delivery) and may link to third-party websites or resources. We do not control and are not responsible for those third parties. Your use of third-party services is at your own risk and subject to their terms. Our Privacy Policy describes how we handle information with service providers.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy. Account deletion instructions are at Delete Account.

13. Availability and Changes

We may update, suspend, or discontinue any part of the website or mobile app at any time. We do not guarantee uninterrupted or error-free access.

14. Disclaimers

TalkPebble and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

15. Limitation of Liability

To the fullest extent permitted by law, TalkPebble and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use TalkPebble or reliance on its content. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

16. Termination

We may suspend or terminate access to the website or app if you violate these Terms or if we need to protect the services, our users, or our operations. You may stop using TalkPebble at any time and may request account deletion as described on the Delete Account page. Provisions that by their nature should survive termination will survive.

17. Governing Law

These Terms will be governed by the laws of the jurisdiction in which TalkPebble’s operating entity is established, without regard to conflict-of-law principles. The specific legal entity, registered address, and governing jurisdiction for TalkPebble have not yet been finalized in these draft Terms and should be completed following professional legal review before relying on this section in production.

18. Changes to Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. Continued use of TalkPebble after changes means you accept the updated Terms.
